1. Definitions
"Client" means the business commissioning a Nuvio engagement. "Engagement" means any assessment, advisory or certification service provided by Nuvio. "Report" means any written deliverable produced as part of an engagement.
2. Scope of services
Nuvio provides independent customer experience assessments, executive intelligence reports, benchmarking and certification. The scope of each engagement is described in the accepted proposal and the Nuvio Standard™ methodology.
3. Independence
Nuvio operates as an independent assessor. We do not accept inducements of any kind from clients, vendors or third parties that may influence assessment outcomes. Scoring is determined solely by application of the Nuvio Standard™.
4. Fees and payment
Fees are as stated in the accepted proposal or the prices published on the Nuvio website. One-off engagements are invoiced on commission. Subscription engagements are invoiced monthly in advance and may be cancelled at the end of any billing month on seven days written notice.
5. Reports and use of findings
Reports are prepared for the exclusive use of the Client. The Client may share reports internally and with professional advisors. Public reproduction, in whole or in part, requires written consent from Nuvio. Reports represent the considered opinion of Nuvio based on the methodology and the visits performed.
6. Certification
Use of the Nuvio Certified™, Nuvio Gold™ and Nuvio Platinum™ marks is permitted only while the relevant certification is current and only in accordance with the Nuvio brand standards. Certification may be suspended or withdrawn where standards are no longer met.
7. Confidentiality
Nuvio holds all client information and engagement outcomes in strict confidence. Anonymised data may be incorporated into our benchmark dataset and published only in aggregated form.
8. Liability
To the extent permitted by law, Nuvio's total liability arising from any engagement is limited to the fees paid for that engagement. Nuvio is not liable for indirect or consequential loss.
9. Governing law
These terms are governed by the laws of New Zealand and the parties submit to the exclusive jurisdiction of the New Zealand courts.
